[Malaysiakini] Cheras saga continues - toll operator vows to rebuild wall

Toll operator Grand Saga has today vowed to rebuild the concrete barricade to block a toll-free access road to the Cheras-Kajang Highway in Bandar Mahkota Cheras (BMC).

Notice is hereby given that the company will be constructing the barricade this week,” said Grand Saga’s executive director Zainal Abidin Ali in a terse press statement.

Zainal Abidin, who is former Dang Wangi police chief, said that Grand Saga had constructed the barricade in 2005 “to prevent unlawful access” to the highway through the access road from BMC.

In April 21, the original barricade was demolished by the outraged residents with the help from BMC developer Narajaya.

However, an attempt to rebuild the three-feet high wall by Grand Saga - for the third time - on the night of May 8 was abandoned after volleys of tear gas were fired at an angry crowd.

Residents have accused the riot police of siding with Grand Saga in the dispute. Four days later,  the residents failed to get the High Court to restrain the toll operator from re-erecting the barricade.

Zainal Abidin (right) said the court, in throwing out the injunction, had noted that Grand Saga has the right to build a barricade “within its indisputable concession area”.

“Members of the public are advised to respect the decision of the court,” he warned.

The new Selangor government has however argued the area where the barricade was built on was part of state land and questioned Grand Saga’s right in erecting the barrier.

In an immediate response, Mentri Besar Khalid Ibrahim said that the access road should remain open pending the resolution of another court case filed by Narajaya against Grand Saga.

"This is a problem between two companies. Let the court decide," he said.

No resolution after 7-day deadline

Since the barrier was demolished, motorists have been using the controversial access road, resulting in traffic jams in the area.

According to Zainal Abidin, the current situation endangers motorist not only from BMC but also the surrounding townships.

He argued that Grand Saga was responsible in maintaining the safety of its road users.

But residents retorted that it was the prerogative of toll operator to install traffic lights and provide proper signage to ensure the safety of road users.

The toll concessionaire barricaded the access road three years ago, a move which upset the residents who had been using the road to enter the expressway without having to pay toll at the Batu 11, Cheras.

The concrete barrier forced commuters to travel an additional six kilometres and pay Grand Saga 90 sen toll for every trip they make [see Google map below].

Two weeks ago, Selangor Menteri Besar Abdul Khalid Ibrahim had given all the parties involved in the dispute - Grand Saga, Narajaya and the Malaysian Highway Authority - seven days to reach an amicable solution.

But Zainal Abidin said that “the issue unfortunately has not been resolved” after the lapse of the seven days.

Grand Saga has not given the actual date when it plans to rebuild the barrier but there could be a repeat of the rowdy May 8 protest from the residents should it proceed.

    Give BMC a CHERAS exit, then you can build the
    barricade. Doesn't make sense Cheras residents
    to take Kajang exit.

    YB,
    I thought you said that there were strong evidence on the
    state government side in this case? Why now the High Court in
    favor of Grand Saga?
    Also i'm very surprise the word "go back to China" coming from
    a former police chief.

    if there is strong evidence from the state
    government, I don't detect strong reasons from
    the High Court.

    This feels like being kicked in the hurt zone
    without being told why

    You are absolutely right, please put back the
    barricade at fast as possible!

    Besides, please do not forget to put sign
    boards along Jalan Cheras to remind Malays to
    go back to Indonesia, Chinese to go back to
    China and Indian to go back to India if
    refused to pay the fee!

    replying to YB's comment that she was confident about the facts
    on the state government side. I want to know from her why the
    court's decision is not in favor of them this time. This is a
    fair request from an ordinary malaysian like me.

    outside the state road. Fine. Any way the Selangor
    Govt can build an access road to prevent us from
    going through the Batu 11 toll?

    disclosing the hanky-panky happened during
    BN's time. We need to be cautious as BN,
    especially the ex-MB & his crony, might try to
    divert our attention by "stretching" the BMC

    didn't right of way to Rakyat, i think we
    shouln't give our "RIGHT" to vote them

    BN anymore since right of way belong to TOLL
    COMPANY, and please rename our malaysia to
    TOLL in the world and not malaysia boleh, and
    is TOLL BODOH or malaysia bodoh, after 308,

    rakyat is a boss, without rakyat, where got PM?

    TOLL build is to let rakyat more easy and fast
    on the road, but BN and Grand saga build toll
    is force BMC and surrounding rakyat use and
    pay for it without alternative road, this is
    logical?
    We at BMC, and is not at KLCC, Jalan Ampang,
    not need FRU coming, FRU is protect country
    and is not buli rakyat. Heard grand saga
    employed Gangster for jaga the road for this
    time, then we should call POLICE and FRU to
    protect us since we are just normal rakyat and
    is not gangster, POLICE, where are you? we
    need your help to protect us now.

    I think PR is weak. Too weak. Really a disappointment for us. If
    the BMC case happen in BN state and they are on the rakyat side,
    I think by now the owner of the company already have been
    arrested for illegal building block. They are bullying PK now.
    Can't you all see?? What action is going to be from PR? Can
    anyone stop them?Even the MB words also they ignore. They
    build illegal building on state land and yet protected by police
    which suppose to be works to reducing the crime but become guard
    of some construction company. Is this right?.We should call them
    the security guard. They protect those who have money like GS
    not the people.

    Building an alternative access road is
    definately one of the options. But it will
    take some time.

    I would urge the state government to build an
    alternative road if the court decides in Grand
    Saga's favour in their suit against Narajaya

    Been to the BMC access tonight. Many people
    say about 'someone' sent samseng this time to
    guard the barricade and causing chaos and few
    resident has been hit - I believe we can see
    the news in tomorrow paper. By the way, ladies
    and children are not advise to go there.

    My advise - please don't be emotional. we know
    maybe 'some party' is trying to cause riot.

    By the way, nobody is given the permission to
    open nor close the road. I suggest people to
    lodge police report against someone who
    already broke the rule.

    了。此君三番二次的壞了大事,搞到貴公司猶如過街老鼠似

    should call GranD SAGA as KING OF MALAYSIA.
    they claimed they have permit to block it,
    however, from my i see, is under state
    selangor land, why don't just instruct MPKJ
    take action for stop them and take out
    all "BATU", why? why? is because of scare
    of "Grand SAGA", POLICE, FRU OR federal
    government, meeting for many times also no
    solution, what for meeting and meeting? please
    take some action, i am here is not going to
    blaim PR, but just to showed out why PR don't
    take some practical action since the land is
    under state selangor rather than meeting.
    we would like to invite ANWAR to come to BMC
    for showed KEADILAN since Minister selangor

    no, what i means is even "land" is may not
    fall under state selangor, but why PR not
    showed "power" to federal government, what we
    feel that is state selangor is scared of
    federal government, and always talking
    about "law" in front of us, they should start
    sue Federal government if they claim that
    Rakyat have right to access the road, and take
    some practical action for help us, rahter than
    meeting. Federal government has showed their
    power, why not state selangor show PR
    power,why scare? we (rakyat) don't have power
    to show, however, they are the one who
    represent us to show power in order to show
    they are really practically support us.
